Our client was pulled over for going 92 in a 65 on the Chisolm Trail Tollway in Fort Worth, Texas a couple of blocks from his house. The Fort Worth Police Officer claimed to have smelled alcohol and noticed bloodshot eyes. She conducted SFSTs and completed many of the instructional phases incorrectly. Client claimed he had two alcoholic gin drinks and most recently a beer 10 minutes before he was pulled over. After being arrested, client submitted to a breath test and the results were 0.099 and 0.102. We were able to argue that the time of his last drink was too close to the stop and the analyst was unable to prove that his BAC was 100% over 0.08 at the time of driving. The Jury found our client Not Guilty of DWI!
