Client was driving home in Dallas, Texas after being at a bar. He struck a curb which damaged the front end of his car and popped his 2 left tires. A 911 caller said they observed client driving on just the rim of the wheel and that he was “highly intoxicated.” The Cedar Hill Police Department arrived on scene to find the car abandoned. They found client’s license in the vehicle and went to his home to investigate. At the house, the officer said he smelled a strong odor of alcohol, heard slurred speech, and testified that our client failed all the field sobriety tests. The blood draw indicated that the client’s blood was a .20. At the hearing, Matt Peacock showed the judge, through evidence and case law, that the search, seizure, and arrest of our client was done illegally by the officer. After reviewing everything, and hearing Matt’s argument, the Judge ruled to suppress the evidence and DISMISSED the case.
