The legal limit for alcohol in the blood or breath in Texas is 0.08. Now, that means that if you have 0.08 or greater alcohol concentration in your blood, breath, or urine even at the time of driving, then you may be guilty of driving while intoxicated.
But, there has to be proof that the 0.08 was at the time of driving not just at the time of the test. You can also be intoxicated under Texas law by not having the normal use of mental and physical faculties regardless of the 0.08 level.
